What was your attorney doing this time last year?

Mr. Budgen has filed cases throughout Florida, in state, bankruptcy and federal district courts, including winning oral arguments before the U.S. Court of Appeals.

DO NOT LET YOUR BANKRUTPCY CASE BECOME THE CASE YOUR ATTORNEY LEARNS FROM!

Ask your attorney the number of cases they have filed in the bankruptcy court. Ask them if they have represented banks, creditors and debtors. Ask them how many contested cases or adversary proceedings they have handled. If they do not know what an “adversary proceeding" is, run!

How to find your attorney:

There are a few tricks only experienced attorneys want you to know. Check the year your attorney was admitted. Is it at least longer than the age of your debt? See if your attorney has any disciplinary history in the past 10 years. Look them up at http://www.floridabar.org/public/

See what your attorney's court history is like, do they have noteworthy cases?

  • Ask your attorney how many cases they have filed.

  • Ask your attorney do they handle adversary proceedings and Chapter 13s which are often more complicated than Chapter 7s.

  • Ask your attorney what their bankruptcy-approved hourly billing rate is?

This rate exhibits court- recognized experience.

  • Ask your attorney do they subscribe to research software?

How does he know the latest case trends?

  • Does your attorney have reported casework and decisions?

Noteworthy cases, where the attorney fought an issue, often become "reported", creating new "case law". We have a reported decision for nearly every year our attorneys have been practicing.
